Trucking Company Ticket Defense in NYC Criminal Courts

We handle all New York City Criminal Court Truck Pink Tickets

  We handle all Pink Tickets that are written for New York City Criminal Court.

Usually these pink tickets are written to the corporation instead of the driver and can include

  • Equipment violations under Trans Law 140.2
  • No Hut Permit or MVT Stamp
  • Wrong or no DOT Address on Truck
  • Improper driver logs
  • No daily inspection logs
  • Overweight and/or overlength violations
  • Unsecured load
  • Reckless driving (this one is usually given to the driver)


With equipment violations, the NYC Criminal Court Judges or JHO's (judicial hearing officers) will usually dismiss these tickets if we show proof on the court date that the equipment violations were repaired within 24 hours of when the driver was given the ticket.


The 24 hour rule is stated under New York State Transportation Law 140. a. (often written as NYS Trans law 140) 


  "Acceptable proof of repair or adjustment shall consist of submission to the court on or before the return date of the summons of (I) a statement of correction from an officially designated state inspection station duly executed by the person performing or making such inspection and bearing the official stamp of the state inspection station, (II) a statement of correction* from an automobile repair shop on the letterhead of such repair shop duly executed by the person who made the correction or (III) a signed statement of any police officer or a department inspector that the necessary corrections have been made.  The statement required by this subparagraph shall be directed to the court having jurisdiction of the alleged violation, shall be affirmed as true under penalty of perjury, and shall include the name, occupation and position of the person making the statement, the time and date that the repairs or inspection were made and a statement that the defective equipment, cited in the violation, on the vehicle in question, is in proper working order"  


*Usually the courts will accept the bill from the repair shop provided the bill includes the shop's name, address, date and the plate number of the vehicle.
